Ed Sheeran has successfully defended against a copyright infringement claim concerning his 2014 hit “Thinking Out Loud,” with a U.S. appeals court affirming a prior ruling that the song does not illegally copy Marvin Gaye’s 1973 classic “Let’s Get It On.” The 2nd U.S. Circuit Court of Appeals supported the dismissal of a lawsuit filed by Structured Asset Sales, which claimed ownership of rights to Gaye’s song, stating that the musical elements were too common to warrant copyright protection. The court also ruled that the similarities between the two songs were not substantial enough to constitute infringement. A related lawsuit remains on hold as SAS has filed another claim based on its rights in the actual recording of Gaye’s work.
