Texas Hemp Industry Sues State Over Ban on THC Products
Hemp industry members in Texas are suing the state over a ban on hemp-derived THC products.

In Texas, three members of the hemp industry have filed a lawsuit against the state following a controversial ban on most hemp-derived THC products. The plaintiffs, two retailers and a distributor, argue that this classification violates the 2018 Farm Bill, which legalized hemp and undermines interstate commerce. Their actions, initiated in the U.S. District Court for the Southern District of Texas, seek to halt the ban, which recently criminalized popular products like delta-8 and delta-10 THC, while leaving only delta-9 THC legal. The state’s abrupt changes, prompted by a Texas Supreme Court ruling, threaten the livelihoods of approximately 14,000 licensed retailers and leave the industry grappling with uncertainty as new legislative sessions loom.
