A federal judge in Texas has blocked the National Labor Relations Board from pursuing claims that SpaceX forced workers to sign illegal severance agreements, pending the outcome of the rocket maker’s challenge to the agency’s structure. The judge, Alan Albright, granted a temporary block on the NLRB’s administrative case after SpaceX argued it would be “irreparably harmed” by facing an unconstitutional proceeding and covering the legal costs of defending itself. This decision comes after SpaceX sued the labor board in April, claiming that the NLRB’s in-house enforcement proceedings violate the US Constitution because its administrative judges and board members cannot be removed without cause. The case is one of several challenges to the NLRB’s structure, with other companies including Amazon, Starbucks, and Trader Joe’s also bringing similar claims.
